2. Sources of Personal Information

We may obtain personal information:

  • directly from you when you place an order, create an account, subscribe to marketing, contact us or otherwise provide information;
  • automatically when you use our website, including through cookies and similar technologies;

3. How We Use Personal Information

We process personal information only where we have an appropriate purpose and legal basis.

Providing products and fulfilling orders

We use personal information to process payments, confirm orders, arrange delivery, provide order updates, process returns and refunds, manage customer accounts and otherwise fulfil our agreement with you.

For customers in the European Economic Area (“EEA”), the legal basis for this processing is generally the performance of a contract or taking steps at your request before entering into a contract, in accordance with Article 6(1)(b) GDPR.

Customer service and communication

We use personal information to answer questions, handle requests, resolve problems and communicate with you about our Services.

Depending on the circumstances, this processing is necessary for the performance of our contract with you or is based on our legitimate interest in providing effective customer service and operating our business, in accordance with Article 6(1)(b) or Article 6(1)(f) GDPR.

Legal and regulatory obligations

We may process and retain personal information where necessary to comply with tax, accounting, consumer protection, regulatory or other legal obligations.

The legal basis is compliance with a legal obligation in accordance with Article 6(1)(c) GDPR.

Security and fraud prevention

We process certain information to protect our website, customers and business, prevent fraudulent or abusive activity, maintain account security and investigate suspected misuse.

The legal basis is our legitimate interest in protecting our customers, systems and business, in accordance with Article 6(1)(f) GDPR.

Website operation and improvement

We may use information to maintain, troubleshoot, understand and improve our website and Services.

Where the processing is necessary for essential website functionality or security, we may rely on our legitimate interests under Article 6(1)(f) GDPR.

If you choose to subscribe to our marketing communications, we may send you information about Primal Wolf products, availability, offers or other relevant updates.

Where required by law, we rely on your consent under Article 6(1)(a) GDPR. You can withdraw your consent at any time by using the unsubscribe function in our marketing communications or by contacting us.

Withdrawal of consent does not affect processing that took place lawfully before withdrawal.

4. Cookies and Similar Technologies

We and our service providers use cookies and similar technologies to operate our website, maintain security, remember preferences, understand how our Services are used and, where permitted, provide personalisation and advertising.

Some cookies are necessary for the website to function and cannot reasonably be disabled through our consent mechanism.

Where required by applicable law, non-essential cookies and similar technologies are activated only after you have provided consent. You can review or change your privacy and cookie preferences through the privacy controls available on our website.

You can also control cookies through your browser settings. Blocking certain cookies may affect the functionality of parts of our website.

5. Relationship with Shopify

Our online store is hosted and powered by Shopify.

Shopify processes personal information to provide the ecommerce infrastructure and services that enable us to operate our store, process transactions, provide customer accounts and deliver other functionality.

We have enabled Shopify Network Intelligence and may use Shopify Enhanced Services.

These services can use information about interactions with our store together with information from interactions with Shopify and other Shopify merchants. This can enable Shopify and participating merchants to provide more personalised experiences, understand customer interactions, improve services and, where consent has been provided, deliver more relevant advertising.

Information relating to your activity on our store may therefore be shared with Shopify and other service providers, including parties that may process information in countries outside your country of residence.

For some Enhanced Services, Shopify acts as an independent controller of personal information and is responsible for responding to requests relating to Shopify's own processing.

You can learn more in the Shopify Consumer Privacy Policy and use the Shopify Privacy Portal to manage certain privacy choices and exercise rights relating to Shopify's processing.

Where required in the EEA, personalised advertising and other non-essential tracking through Shopify Network Intelligence are subject to consent choices made through our website's privacy controls.

6. How We Share Personal Information

We may share personal information with third parties where necessary for the purposes described in this Privacy Policy.

These recipients may include:

  • Shopify;
  • payment processors;
  • shipping and fulfilment providers;
  • IT, hosting, security and technical service providers;
  • analytics providers;
  • customer service providers;
  • marketing and advertising providers where permitted by law and, where required, with your consent;
  • professional advisers such as accountants or legal advisers;
  • public authorities or regulators where disclosure is required by law.

We may also disclose information in connection with a reorganisation, sale or transfer of all or part of our business, subject to applicable law.

We do not permit service providers acting on our behalf to use personal information for purposes unrelated to the services they provide to us, except where they independently determine the purposes and means of processing under applicable law.

7. International Transfers

Some of our service providers, including Shopify, may process personal information outside the country where you live.

Where personal information is transferred outside the EEA to a country that has not been recognised as providing an adequate level of data protection, appropriate safeguards may be used, such as the European Commission's Standard Contractual Clauses, where required.

Although our Shopify data storage location is configured for the European Union, certain processing by Shopify or other service providers may still take place internationally in accordance with applicable data protection requirements.

8. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including to:

  • fulfil orders and provide our Services;
  • maintain appropriate business and transaction records;
  • comply with tax, accounting and other legal obligations;
  • resolve disputes;
  • prevent fraud and maintain security;
  • establish, exercise or defend legal claims.

Different categories of personal information may therefore be retained for different periods.

When personal information is no longer required, we will delete, anonymise or otherwise handle it in accordance with applicable law.

9. Security

We take reasonable organisational and technical measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

However, no online service or method of electronic transmission can be guaranteed to be completely secure.

You are responsible for protecting any login codes or other account credentials associated with our Services and should not share them with others.

10. Your Privacy Rights

Depending on applicable law and your location, you may have rights regarding your personal information.

For individuals in the EEA, these may include the right to:

  • request access to personal information we process about you;
  • request correction of inaccurate or incomplete information;
  • request deletion of personal information where the legal requirements are met;
  • request restriction of processing in certain circumstances;
  • object to certain processing based on legitimate interests;
  • receive certain personal information in a portable format;
  • withdraw consent where processing is based on consent;
  • object to or manage certain direct marketing communications;
  • lodge a complaint with a competent data protection supervisory authority.

These rights are not absolute and may be subject to legal conditions or exceptions.

We may need to verify your identity before responding to a privacy request.

You may exercise your rights by contacting us using the details below.

You also have rights relating to certain personal information processed independently by Shopify. The Shopify Privacy Portal can be used to learn more about and exercise certain rights relating to Shopify's processing.

11. Marketing Communications

If you subscribe to email marketing, you can unsubscribe at any time using the unsubscribe link included in our marketing emails.

Even if you unsubscribe from marketing, we may still send transactional or service-related communications, such as order confirmations, shipping updates, security messages or responses to customer service requests.

12. Third-Party Websites and Services

Our website may contain links to third-party websites, social networks or other services.

We are not responsible for the privacy practices of third parties that we do not control. We recommend reviewing their privacy notices before providing them with personal information.

13. Children's Privacy

Our Services are not intended for children and we do not knowingly collect personal information from children in circumstances where doing so would not be permitted by applicable law.

If you believe that a child has provided us with personal information unlawfully, please contact us so that we can assess and, where appropriate, delete that information.

14. Complaints

If you have a concern about how we process your personal information, please contact us first so that we can try to resolve the issue.

You also have the right to lodge a complaint with a competent data protection supervisory authority.

Because Primal Wolf is established in the Netherlands, you may contact the Dutch Autoriteit Persoonsgegevens. If you live elsewhere in the EEA, you may also lodge a complaint with the supervisory authority in your country of habitual residence, place of work or place of the alleged infringement.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our Services, technology, business practices or legal requirements.

When we update this Privacy Policy, we will update the “Last updated” date and provide any additional notice required by applicable law.
